Nationwide Ban for Bath Salts?

South Carolina Drug Crimes Attorneys

A New York woman has become the latest victim of bath salts.

A Madison County woman ingested bath salts causing her to beat her three-year-old son and attack police. Police were eventually able to subdue the woman through the use of pepper spray and a taser. The woman later died as the result of the tasing.

This enhances the already added pressure for many states to make bath salts illegal and a felony if convicted. New York lawmakers are pushing a bill to make the sell or possession of bath salts a felony.  Currently in New York, the sale is considered a misdemeanor crime.

New York State Senator Flanagan said.  “The impact of these drugs is simply devastating. The Senate passed a strong bill and it should be voted on in the Assembly. We owe it to the children of our state and their parents to make sure that we get this legislation enacted this year.”

The state of Indiana has also seen a dramatic increase in the use of bath salts in 2012. In 2011, officials say they received only 300 calls relating to bath salts. This year the number has jumped to over 9,000 calls.

Indiana is one of 34 states, including New York, who has legislatively banned bath salts as of April of 2012.  Currently in South Carolina bath salts are considered a Schedule I drug. Schedule I Drugs are considered highly addictive.

Currently, legislation enacting a federal ban on bath salts is tied up. On the heels of the “Miami Cannibal” attack, there pressure is on US lawmakers to come up with a plan on what to do about bath salts. For now, there is still an emergency ban on bath salts issued by the United States Drug Enforcement Administration.
